What is a trademark?

A trademark can be a sign, logo, symbol or word that represents your business and your brand assets, it can even be a tagline. It distinguishes your goods and services from your competitors and offers a robust platform for brand protection.

It’s how customers and the greater community recognise the unique aspects of your business in the marketplace and helps to distinguish your business from its competitors.

A trademark is not the same as a domain name, business name or even company name. However, by registering all of these as trademarks allows you to have exclusive rights to each of them in Australia under Trademark Laws.

What are the benefits?

A registered trademark gives you or your business exclusive rights to use, license and sell the trademark. This means no one else in Australia can commercially use any aspect of your trademark for the same goods or services that you have it registered for.

Your trademark becomes a valuable asset, increasing in value as your business grows and evolves.

✓ Stop other people from stealing your business name, logo or even a tagline and using it for the same goods and services that your business offers.

✓ Once your trademark is registered, it will be protected under the Trademarks Act for a period of 10 years starting from the date that it’s filed.

✓ Your brand is more than just your name or logo, it’s your most valuable asset, so as your business develops so may the value of your trademark.

✓ Add the TM symbol to your products, labels and across all media, digital and social platforms so that people know that it’s your trademark

What is the trademark class system?

All trademarks are registered for specific goods or services, e.g. Microsoft for “software”. Those goods and services are categorised into any one of 45 different classes, providing a convenient and efficient way to search for similar trademarks.
